Finvictum is committed to protecting your personal data and the protection of your privacy. In this privacy statement, we aim to provide clear and transparent information on what data we collect and how we handle personal data. We make every effort to ensure your privacy and therefore treat personal data with care. Finvictum BV complies in all cases with the applicable laws and regulations, including the General Data Protection Regulation.

FINVICTUM BV WILL IN ANY CASE:

  • Process your personal data in accordance with the purpose for which they are provided, these purposes and types of personal data are described in this privacy statement;
  • Limit the processing of your personal data to only those data that are minimally necessary for the purposes for which they are processed;

WHY DO WE PROCESS PERSONAL DATA

Your personal data are always processed lawfully by Finvictum bv as a result of the following purposes:

A. LEGITIMATE INTEREST:

  • To be able to contact you by e-mail or telephone or by post so that our services run performantly
  • Preparing and following up offers and prospects, maintaining Data from customers and subcontractors
  • Sending newsletters and news about updates, products and services on a regular basis. The addressee can easily and at any time unsubscribe from email marketing.

B. EXECUTION OF CONTRACTUAL AGREEMENTS

  • Execution of contractual obligations towards listed companies engaging with Finvictum

Provision of services to individuals using the mobile app, web app or website, including sending personalised messages and newsletters about Finvictum's clients.

C. LEGAL OBLIGATION:

  • Invoicing customers and making appointments with suppliers
  • Sending out alerts regarding Cybersecurity or other dangers related to the information shared on our platform

Legal obligation or one following a ruling by a court that has become res judicata.

D. EXPLICIT CONSENT:

  • Use of cookies on the website
  • Storing personal data transferred via the digital platforms by users of the mobile or web app or website
  • Communicating usersinformation of the app or website module to the listed companies that are Finvictum clients and in which the user has expressed interest,
  • recording phone calls and chats conversations to improve our service

FOR THE ABOVE PURPOSES, WE PROCESS OR MAY PROCESS THE FOLLOWING DATA:

  • Personal identity data: surname, first name, address, telephone number, e-mail
  • VAT and KBO number
  • E- mail address
  • URL
  • Mobile phone number
  • National registry numbers
  • Meta data via cookies whereby your unique IP address is recorded together with your preferences, the way you use the website, how often you visit the website, how and with which devices you do so and which language you use. For details, please refer to the cookie policy.

PROVISION TO THIRD PARTIES

We may provide the data you provide to us to third parties if this is necessary for carrying out the purposes described above.

For example, we use a third party for:

  • Maintaining the website
  • Maintaining of the IT infrastructure (including IT network, ...);
  • Providing newsletters and e-commerce Invoicing
  • Mail traffic
  • Keeping the accounts
  • Management by the independent directors – shareholders
  • Placing cookies on your devices 
  • Storing data in the Cloud
  • Legal services
  • Back-up services
  • Security, Compliance and Privacy services

With these parties (processors) we make the necessary agreements herein to ensure the security of your personal data.
Furthermore, we will not pass on the data provided by you to third parties unless required and permitted by law.
We do not provide personal data to parties located outside the EU, unless it is confirmed that there are sufficient guarantees for security and privacy protection.

RETENTION PERIOD

Finvictum bv does not keep personal data for longer than necessary for the purpose for which they have been provided or required by law. The data of shareholders of the Listed Companies communicated to them by the service providers are kept for a maximum of 1 year unless the shareholder has become a user of Finvictum's app or web application during that year and has thus entered into a contract with Finvictum.
Invoicing data are kept at least until 7 years after the end of the last financial year in which the last invoice was issued to the customer, unless there is another legal or contractual obligation that makes it necessary to keep the personal data longer.
Unless otherwise indicated, customers' personal data are kept for 1 year after the end of the contract because Finvictum has a commercial interest in keeping these data for that long.
Data of prospects or casual contacts are kept for 1 year after initial contact.
Data that reach us via website without the data subjects becoming customers are deleted after 1 year.
Backup data are stored in encrypted (annotated) form for 1 year.

DATA SECURITY

We have taken appropriate technical and organisational measures to protect personal data of yours from unlawful processing, for example;

  • All persons who may have access to your data on behalf of Finvictum bv are obliged to respect confidentiality.
  • We maintain a username and password policy on all our systems;
  • We make backups of personal data in order to restore it in case of physical or technical incidents;
  • We regularly test and evaluate our measures;
  • Our processors are informed of the importance of protecting personal data.
  • Data is stored on a secure server in the cloud. This also applies to backup data;
  • Finvictum’s programmers and employees can only access Finvictum's database and platform via a 2FA

YOUR RIGHTS REGARDING YOUR DATA

You have the right to access, correct or delete personal data we have received from you. At the top of this privacy statement you will find how to contact us to address your questions. You can send an email to gdpr@finvictum.com or sent us a letter to correct or delete your personal data from our systems.

You can also object to the processing of all or part of your personal data by us or one of our processors.

You also have the right to have us transfer the data you have provided to yourself or on your behalf directly to another party. We may ask you to identify yourself before we can comply with the aforementioned requests.
